These Terms and Conditions ("Terms") govern your use of the AdLaunch platform ("Platform"), provided by Get Leads Now, LLC, doing business as AdLaunch ("AdLaunch," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Platform.

1. Definitions

1.1 "Platform" refers to the AdLaunch software as a service (SaaS) solution, including all associated features, tools, and services provided by AdLaunch.

1.2 "User" refers to any individual or entity that accesses or uses the Platform.

2. Use of the Platform

2.1 Eligibility: By using the Platform, you represent and warrant that you have the legal capacity to enter into these Terms and that you are not prohibited by any applicable law from using the Platform.

2.2 Account Registration: To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the security of your account credentials.

2.3 Prohibited Activities: You agree not to engage in any of the following prohibited activities while using the Platform: Violating any applicable laws or regulations.Uploading, sharing, or transmitting content that is illegal, harmful, defamatory, infringing, or otherwise objectionable.Attempting to gain unauthorized access to the Platform or its systems.Reverse-engineering, decompiling, or otherwise attempting to extract the source code of the Platform.

3. Subscription Plans and Fees

3.1 Subscription Plans: AdLaunch offers various subscription plans, each with its own features, limitations, and pricing. The details of the available plans are provided on the AdLaunch website.

3.2 Payment: By subscribing to a paid plan, you agree to pay the applicable fees as specified on the AdLaunch website. Payment methods accepted will be detailed on the website. Fees are non-refundable unless otherwise explicitly stated.

3.3 Refunds & Chargebacks:

By purchasing any AdLaunch plan, subscription, or lifetime access product, you agree that all sales are final and no refunds will be issued under any circumstances unless otherwise stated in a written and signed agreement.

AdLaunch offers full demos and onboarding services to ensure clarity before purchase. You acknowledge that you have had the opportunity to review the platform, its features, and its limitations.

Any attempt to reverse a valid charge (chargeback) after accessing the product will be considered a breach of these Terms. We reserve the right to pursue legal remedies, suspend or terminate access, and report fraudulent chargebacks to relevant authorities and platforms.

4. Intellectual Property

4.1 Ownership: AdLaunch retains all rights, title, and interest in and to the Platform, including all intellectual property rights associated with it.

4.2 User Content: You retain ownership of any content you upload or create using the Platform ("User Content"). By uploading User Content, you grant AdLaunch a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and distribute the User Content for the purpose of providing and improving the Platform.

5. Privacy

5.1 Privacy Policy: Your use of the Platform is also governed by our Privacy Policy, which can be found on the AdLaunch website.

6. Limitation of Liability

To the fullest extent permitted by law, AdLaunch, its owners, partners, affiliates, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or any loss of profits, revenue, data, or use arising from your use of the platform or any service provided.

All content, services, and tools are provided “AS IS” and “AS AVAILABLE”, with no warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

6.1 Disclaimer: The Platform is provided on an "as is" and "as available" basis. AdLaunch disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Termination

AdLaunch reserves the right to suspend or terminate your access at any time, with or without notice, for any violation of these Terms or misuse of the platform.

Upon termination, your license to use the platform will immediately cease, and no refunds or credit will be issued.

8. Use of Branding

You may not use the AdLaunch name, logo, trademarks, or other brand assets in any way that implies partnership, sponsorship, endorsement, or affiliation without express written permission from AdLaunch. This includes, but is not limited to, use in promotional materials, websites, client-facing assets, or resale presentations. Resellers are prohibited from using the AdLaunch logo or branding when marketing or delivering services unless specifically authorized in writing.

9. Changes to the Terms

9.1 Updates: AdLaunch may update these Terms from time to time. Any changes will be effective upon posting the revised Terms on the AdLaunch website. It is your responsibility to review the Terms periodically for changes.

10. Governing Law and Dispute Resolution
